Anthony defense wants some evidence thrown out

Casey Anthony's defense team is trying to get some potential evidence thrown out in in State's capital murder case against their client.

Remember the frantic 911 call made by Casey's mom Cindy back in July 2008? "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony told a 911 dispatch operator. Casey's lawyers are asking the judge to throw it out so, so a jury could never hear it. The defense's argument, that there was not an emergency at the time the call was made. The defense argues that 2-year-old Caylee had already been missing for 31 days. Therefore, they argue the call is neither spontaneous or reliable.

That's not all the defense doesn't want a jury to see. Remember the photos of Casey partying? The defense says only the pictures captured of Casey wearing a blue dress were snapped during the time that Caylee was missing. According to the photographer, pictures of Casey partying in that blue dress were taken June 20-21 at Fusion night club. That was less than a week after Caylee was last seen alive.

"These pictures do not bear a single issue in this case," according to Casey's defense team. "Their only value is to paint a picture of an irresponsible, drunken, promiscuous and wild defendant." The defense states that those pictures contain "inflammatory imagery that would unfairly prejudice Miss Anthony before a jury."

The defense also asks the judge to throw out all "hear say" statements between Casey's friends and family. The defense categories those into hearsay that would categorize Casey Anthony as a thief, a liar or a bad mother.

The defense has asked that the state respond to these motions within one month.

More documents are expected this week in the case against Casey Anthony. As the case progresses her attorney fees are starting to add up. Her lawyers want taxpayers to help foot the bill.

Anthony’s defense team filed a motion to get the state to help pay the cost of her trial. They say money is needed for travel, serving subpoenas, hiring experts and more.

It always makes me laugh when he says that. The pictures exists because Casey was irresponsible, drunken and promiscuous. Can't unring a bell, Jose.

Bozo Baez at his best once again!! He only wants to try to get this evidence thrown out because he knows it will help to hang his precious Casey!!! He makes me sick!!!!! How this man can sleep at night knowing all too well that noone but Casey killed Caylee and he is fighting so hard to defend this monster is beyond me!!!! He's just as sick as Casey in my eyes!!!! Is he fighting so hard for Casey so she can kill another baby if she gets away with this????? ARGHHHH!!!!!!!!

The truth hurts! But as Strickland once stated ~ Casey and the truth don't know each other ~ or something to that effect.


Not only does Baez want crucial statements thrown out which are not hearsay, but caught on tape, legally, but he wants the state of Florida to pay her defense team fees and expenses, along with those of experts like Dr. Henry Lee. Let's just get all this B.S. out of the way so the trial can get started. No wonder the judge set the date for the trial for 2011.

Why does Casey Anthony’s defense team want certain photos of her kept out of her murder trial?

“The defense argues that these pictures, many of them, were taken even before Caylee disappeared,” WESH-Channel 2’s Bob Kealing reported this afternoon. “They argue they’ve been shown in an attempt to quote ‘vilify’ her in the eyes of potential jurors.”

WFTV-Channel 9 anchor Martie Salt put the development this way: “Attorneys don’t want a jury to see controversial photos of Casey partying because they say the pictures were taken before Caylee disappeared.”

WKMG-Channel 6’s Mike DeForest on Monday had reported on the defense’s moves to keep the photos out.

Anthony is charged with first-degree murder in the death of her daughter, Caylee.

The photos show Anthony partying, dancing and drinking, and the defense calls the images “irrelevant evidence.”

Kealing also explained the state’s position: “The photos taken while Caylee was missing, investigators have argued, show that Casey was not looking for her missing child and not overly concerned about [Caylee's] welfare or whereabouts.”

The defense also wants Cindy Anthony’s911 call kept out of the murder trial as part of “a motion to exclude hearsay evidence, gossip and innuendo,” Kealing said.

WFTV’s Salt said a defense motion seeks “to keep testimony about Casey’s character out of the case.”

WESH also reported that today the defense team finished deposing investigators who worked on the case.

I want to hear Cindy Anthony state that she did not think it was an emergency when she made that phone call. I know, in Casey's mind, it was not an emergency, but Cindy's voice is definitely excited and urgent. How could they go back, in hindsight, and state it's not an emergency? There's no way anyone could convince me that Cindy did not consider Caylee missing at that point as an emergency. Shame on YOU, Baez!

Right, and I think I remember Cindy trying to retract her statement and that she only said it smelled like a dead body because she was frantic that her granddaughter had been missing for over a month without being reported and she wanted police action immediately. Child missing for 30 days, mother doesn't care or report it, what bigger emergency is there? I understand Baez has a job to do and this is part of it, just hope he isn't successful.

The only time that Cindy ever showed any real and honest emotion was during that phone call.

How silly of me!
Prosecution is showing the real Casey...a selfish, self absorbed, sick individual, therein lies the truth!!
Trying to show otherwise is a fools game! I truly pray the jury can see thru to this truth.
