A 27-year-old man convicted of dealing marijuana was arrested this morning, when police say he was smoking pot on his way home from prison.

Sir James Smith, Indianapolis, was being driven by his wife from Putnamville Correctional Facility when police pulled over their car for a license plate infraction on the 4500 block of west Washington Street at 2 a.m.






Indianapolis Metropolitan Police Officer Erik Forestal said in a report that when he approached the car it smelled of marijuana.

Sharmainique Royal, 21, Indianapolis, was driving the white Nisasan Sentra with the couple's 11-month old daughter, Sir'ir Royal, and friend, Shaneka Williams, 20, Indianapolis, in the back seat, according to the police report.

Royal told Forestal that she had bought some pot to smoke with her husband after they picked him up from prison.

Police found a small amount of marijuana in the car and preliminarily charged Smith, Royal and Williams with possession of marijuana and neglect of a dependent for smoking in the presence of the baby.

The infant was put into custody of the state department of Child Protective Services.

Smith was released from Putnamville after serving four-month sentence for dealing in marijuana, hash oil or hashish, according to Indiana Department of Corrections records.

He had been sentenced previously to two years in prison on the same charge.

I hope they drive him straight back to prison. No stops. No processing. Of course his wife is just as guilty.

Wow did he not learn his lesson? :/ And the mother should be charged with having the crap around the child and smoking it within the same car with the child.

Both parents should be charged with neglect for smoking pot with that baby. But I have to say, I believe we should decriminalize marijuana. IMO, it is the same as drinking, maybe even less harmful, as it does have medicinal qualities. AND, it will free up resource's and money in our prison systems to handle more sex offender's. To me, it's a more than fair trade off. I'd rather have a pot head live next door to me than a RSO or alcoholic.

I agree. In some states it is already legal but still even if it was legal here these two parents would still need to be charged with neglect IMO. What we put in our own bodies is us but to have a innocent child in something as small as a car and smoking around it THAT"S not right.

If they would legalize Marijuana then it would cut down on some of the people we have in prison and also give the Police more time to work on these missing children cases, Missing Adults, or what ever else that is going on within an area.

Making it legal in some states and then not other is giving people reason to believe that the punishment will be a lesser charge in the states that hasn't made it legal yet. Doctor here in my own state are telling patients to smoke it. Elders and youth with certain types of medical problems. THIS is illegal but the doctor knows that using the marijuana will make things easier on their patients. I think with in the next 5 years we will see this being legalized in most of the United States.

BUT I also feel any parent caught doing said smoking around a child under the age of 16 should be charged with Neglect and abuse of a minor. JMO

Anyone below the age of 18 should not be exposed to drugs as this is the time their minds and functioning is nearing completition to interact in adult society. Distribution in an organized crime setting should still net you jail time. However the medical studies have seemed to find links to curing aliments or making them easier to deal with like embyronic stem cells. Plus organized crime rinks like Mexican Drug Cartels will lose profit since their product can easily be bought legitly.

But yes I would rather have a pothead next to my house rather than a repeat sex offender like John Gardner or Fidel Urbina. It would make better use of Law Enforcements efforts and save more potential victims from a much worse fate.

I totally agree, no minor should be subjected to drugs or alcohol for that matter. I think we all know how debilitating an alcoholic upbringing can be to children. And the parent's were driving intoxicated, which is deadly and illegal.
